1.บริการ
1.1ร้านค้าออนไลน์พร้อมใช้งาน sale page)บริการที่ salepage2u ได้ทำการพัฒนาโปรแกรม ออกแบบ ทั้งระบบหน้าร้านค้าออนไลน์ และ ระบบบริหารร้านค้าออนไลน์ โดยผู้ใช้บริการ sale page จะต้องเป็นสมาชิกของระบบร้านค้าออนไลน์พร้อมใช้งาน (สมาชิก) ตามเงื่อนไขของ salepage2u
1.2salepage2u อนุญาตให้สมาชิกมีสิทธิในการใช้ระบบ sale page ตามระยะเวลาและเงื่อนไขในข้อตกลง ซึ่งมิใช่การขายระบบให้แก่สมาชิก โดยสมาชิกสามารถใส่ข้อมูล รูปภาพ และเนื้อหา ผ่านระบบบริหารร้านค้าออนไลน์ของ salepage2u ตามที่ salepage2u ได้ออกแบบไว้
1.3salepage2uขอสงวนสิทธิ์ และ/หรือ สิทธิใดๆ ตามกฎหมาย ในโปรแกรม และ ระบบบริหารร้านค้าออนไลน์ (รวมถึง การออกแบบความสวยงาม) ที่ใช้ในการให้บริการร้านค้าออนไลน์พร้อมใช้งาน และห้ามมิให้ผู้ใดคัดลอก ทำซ้ำ ปรับปรุง พัฒนาต่อ และ/หรือ นำไปใช้ (ไม่ว่าจะเพื่อวัตถุประสงค์ทางการค้าหรือไม่ก็ตาม) โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรล่วงหน้าจากทางsalepage2u
1.4เนื่องจาก ร้านค้าออนไลน์พร้อมใช้งาน และ ระบบบริหารร้านค้าออนไลน์ (รวมถึง การออกแบบความสวยงาม) เป็นงานที่ได้รับการ ออกแบบ และ พัฒนา ตามลิขสิทธิ์ของบริษัท ทางบริษัทสงวนสิทธิ์ในการแสดงให้ปรากฏข้อความ “sale page” และ/หรือ รูปภาพ “sale page” บริเวณด้านล่างของร้านค้าออนไลน์ของสมาชิก ยกเว้นได้รับอนุญาตเป็นลายลักษณ์อักษรจากทางsalepage2u
1.5ในกรณีที่บริษัทรับบริการพัฒนาโปรแกรมเพิ่มเติม ให้เป็นการเฉพาะแก่สมาชิกรายใดรายหนึ่ง บริษัทจะพัฒนาโปรแกรมเป็นส่วนต่อขยายจากระบบมาตรฐานของ sale page โดยมีค่าใช้จ่ายเพิ่มเติมตามข้อตกลงระหว่างบริษัทกับสมาชิก โปรแกรมเพิ่มเติมที่ได้จัดทำเป็นทรัพย์สินของบริษัทเช่นเดียวกับระบบมาตรฐานของ sale page โดยบริษัทให้สิทธิในการใช้งานแก่สมาชิกที่ว่าจ้างพัฒนาโปรแกรมเพิ่มเติม หากสมาชิกยุติการใช้บริการร้านค้าออนไลน์ของ sale page แล้ว สมาชิกจะไม่สามารถนำโปรแกรมนั้นไปใช้ได้อีกต่อไป
1.6บริษัทจะเก็บค่าใช้งานสำหรับสมาชิกที่มีค่าใช้งานเป็นรายปี และจะเก็บค่าบริการอื่นๆของบริษัทที่มีค่าใช้บริการ โดยค่าใช้จ่ายดังกล่าว บริษัทจะได้แจ้งให้สมาชิกทราบก่อนการใช้บริการของบริษัท
1.7เมื่อสมาชิกชำระ ค่าใช้งาน และ/หรือ ค่าบริการ ให้ถือว่าสมาชิกยอมรับข้อตกลงการใช้บริการนี้ และร้านค้าจะไม่สามารถเรียกคืน ค่าใช้งาน และ/หรือ ค่าบริการ ได้ในกรณีใดๆ ทั้งสิน
1.8บริการได้เริ่มต้นเมื่อชำระ ค่าใช้งาน และ/หรือ ค่าบริการ โดยสมาชิกมีหน้าที่ส่งมอบข้อมูล รวมถึงมีหน้าที่ร่วมดำเนินการต่างๆ ที่เกี่ยวข้องเพื่อใช้ในการดำเนินการ ภายในระยะเวลา 45 วัน ทั้งนี้หากเกินระยะเวลาที่กำหนด ถือว่าบริการดังกล่าวได้เสร็จสิ้นครบถ้วนสมบูรณ์แล้ว
1.9salepage2uสามารถเปลี่ยนแปลง แก้ไข และ/หรือเพิ่มเติม ข้อตกลงการใช้บริการได้โดยไม่ต้องแจ้งล่วงหน้า
2.โดเมนเนม (Domain Name)
2.1สมาชิกรับทราบว่าโดเมนเนม หรือ ร้านค้าออนไลน์ที่ได้รับการจดทะเบียนแล้ว จะไม่สามารถเปลี่ยนชื่อหรือขอเงินคืนได้ หากสมาชิกต้องการเปลี่ยนชื่อร้านค้าออนไลน์ของสมาชิก สมาชิกต้องจดทะเบียนโดเมนเนมใหม่ แล้วจึงทำการย้ายข้อมูลจากร้านค้าออนไลน์เดิมของสมาชิก โดยการดำเนินการดังกล่าวจะต้องเป็นไปตามเงื่อนไขการใช้บริการที่บริษัทได้กำหนดขึ้นเท่านั้น
3.การต่ออายุและยกเลิกบริการ
3.1สมาชิกมีหน้าที่ต่ออายุการใช้งานร้านค้าออนไลน์ของสมาชิกเอง ทางบริษัทจะอำนวยความสะดวกแก่สมาชิกในการแจ้งเตือนล่วงหน้าก่อนวันหมดอายุทางอีเมล และ/หรือ โทรศัพท์ สมาชิกยังคงต้องรับผิดชอบการต่ออายุการใช้งานร้านค้าออนไลน์ของสมาชิกเองไม่ว่าสมาชิกจะไม่ได้รับการแจ้งเตือนจากบริษัทหรือไม่ก็ตาม
3.2ในกรณีที่สมาชิกมีความประสงค์จะให้บริษัทดำเนินการต่ออายุโดเมนเนมและร้านค้าออนไลน์ของสมาชิกที่ได้หมดอายุไปแล้ว บริษัทจะให้ความช่วยเหลือในการดำเนินการ ทั้งนี้บริษัทไม่อาจจะรับรองผลสำเร็จของการดำเนินการดังกล่าวได้ เนื่องจากการดำเนินการดังกล่าวขึ้นอยู่กับเงื่อนไขการต่ออายุโดเมนเนมสากล และในกรณีที่การดำเนินการดังกล่าว มีค่าใช้จ่ายต่างๆเพิ่มเติม ที่ต้องชำระให้กับผู้ให้บริการอื่นๆ สมาชิกจะต้องรับผิดชอบค่าใช้จ่ายในส่วนนั้นเองทั้งสิ้น
3.3การยกเลิกการใช้บริการ ปรับลดการใช้บริการ หรือเปลี่ยนแปลงการใช้บริการ กับทางบริษัท ค่าใช้งาน และค่าใช้บริการ ไม่สามารถเรียกคืนได้ ไม่ว่าบางส่วนหรือทั้งหมด
3.4เมื่อสมาชิกได้ยกเลิกการใช้บริการร้านค้าออนไลน์ของสมาชิก สมาชิกจะไม่สามารถเข้าสู่ร้านค้าออนไลน์ของสมาชิกและระบบการจัดการร้านค้าได้อีก และสมาชิกยังรับทราบ และ ยอมรับว่าบริษัทจะทำการลบข้อมูลทั้งหมดในร้านค้าออนไลน์ของสมาชิกตามรอบระยะเวลาการลบข้อมูลของบริษัท สมาชิกมีหน้าที่ต้องเก็บข้อมูลต่างๆ ในร้านค้าออนไลน์ของสมาชิกไว้ในแหล่งเก็บข้อมูลอื่นๆ ของสมาชิกเอง โดยบริษัทจะไม่รับผิดชอบใดๆ ต่อการสูญหาย และ/หรือ ความเสียหายใดๆ ของข้อมูลที่บริษัทได้ทำการลบไปแล้ว
4.ระบบ
4.1สมาชิกมีหน้าที่เก็บรักษา ข้อมูล รูปภาพ และเนื้อหาต่างๆ ที่นำมาแสดงในหน้าร้านค้าออนไลน์ของสมาชิกไว้ในแหล่งเก็บข้อมูลอื่นๆ ของสมาชิกเองเพื่อที่สมาชิกยังจะสามารถนำต้นฉบับข้อมูลที่เก็บรักษาไว้มาใส่ในระบบการจัดการร้านค้าออนไลน์ของสมาชิกใหม่ได้ในกรณีที่เกิดความเสียหายอย่างร้ายแรงแก่ข้อมูลที่นำมาแสดงในหน้าร้านค้าออนไลน์ของสมาชิก
4.2บริษัทได้จัดให้มีการสำรองข้อมูล (Backup) ที่นำมาแสดงในหน้าร้านค้าออนไลน์ของสมาชิกตามมาตรฐานของบริษัท ในกรณีที่เกิดความเสียหายอย่างร้ายแรงแก่ข้อมูลที่นำมาแสดงในหน้าร้านค้าออนไลน์ของสมาชิก บริษัทอาจจะยังสามารถนำข้อมูลที่บริษัทได้สำรองข้อมูลเก็บไว้มาใช้งาน ซึ่งจะเป็นข้อมูลล่าสุดที่ได้สำรองข้อมูลตามมาตรฐานของบริษัท แม้ว่าบริษัทมีนโยบายที่จะทำการพัฒนาปรับปรุงการสำรองข้อมูลอย่างต่อเนื่อง เพื่อให้สามารถจัดเก็บข้อมูลและนำกลับมาใช้ได้อย่างมีประสิทธิภาพ อย่างไรก็ตาม บริษัทไม่สามารถที่จะรับประกันการสูญหายของข้อมูล และ/หรือ ความเสียหายที่เกิดขึ้น ในกรณีที่ข้อมูลที่จัดเก็บมีความสูญหายไม่ว่าในกรณีใดๆ
5.การให้บริการ Payments Online
ธุรกรรมที่ธนาคารไม่รับรอง คือ การขายสินค้าสิ่งผิดกฎหมายหรือสิ่งต้องห้ามจะไม่สามารถชำระผ่านระบบ Payment Online ได้และทาง salepage2u จะไม่รับผิดชอบ เกี่ยวกับสิ่งของต้องห้ามและสิ่งของที่ถูกจำกัดซึ่งไม่ได้รับอนุญาตให้จำหน่าย
5.1ผลิตภัณฑ์จากสัตว์และสัตว์ป่า (รวมถึงแต่ไม่จำกัดเพียงสัตว์ป่า)
5.2ยาเสพติด ยารักษาโรค (ทั้งมีและไม่มีใบสั่งแพทย์) สารเสพติด และยากระตุ้นอารมณ์ทางเพศที่เกี่ยวข้อง เว้นแต่จะได้รับอนุญาตได้รับอนุญาตตามกฎหมายที่เกี่ยวข้อง
5.3สินค้าที่ถูกสั่งห้ามโดยกฏหมายหรือหน่วยงานรัฐบาลหรือองค์กรที่กำกับดูแลในประเทศไทย
5.4อาวุธปืน,อาวุธก่อการร้าย,สเปรย์พริกไทย,สิ่งเทียมอาวุธ และเครื่องช็อตไฟฟ้า เป็นต้น
5.5สินค้าผลิตภัณฑ์อาหารต้องห้าม: เพื่อความปลอดภัยของผู้ใช้ของเรา ห้ามผู้ขายลงรายการสินค้าและสินค้าที่เกี่ยวกับอาหารต่อไปนี้บนไซต์ของเรา
(ก)อาหารเสริมหรือผลิตภัณฑ์ในลักษณะเดียวกันที่ประกาศยกเลิกโดยสำนักงานคณะกรรมการอาหารและยาหรือสินค้าที่ไม่มีเลขทะเบียน อ.ย.
(ข)สินค้าที่มีคำกล่าวอ้างทางการแพทย์ นั่นคือคำกล่าวอ้างว่าสินค้ามีจุดประสงค์เพื่อใช้ในการตรวจวินิจฉัย การรักษา การบรรเทา การบำบัดหรือการป้องกันโรคในมนุษย์ และ/หรือสัตว์ การคุมกำเนิด ทำให้สลบ หรือป้องกันหรือแทรกแซงการทำงานตามปกติของกระบวนการทำงานของร่างกาย ไม่ว่าแบบถาวรหรือชั่วคราว หรือโดยการสิ้นสุด ลด หรือเลื่อนเวลา หรือเพิ่มหรือเร่งการทำงานของกระบวนการทำงานนั้น หรือในลักษณะอื่นใด (เช่น ยารักษาโรค คอนแทคเลนส์ อาหารเสริมปลอมยี่ห้อ)
(ค)สินค้าอาหารให้โทษ - อาหารซึ่งประกอบด้วยสารต้องห้ามหรือสารเกินปริมาณที่อนุญาต อาหารมีสิ่งเจือปนที่ไม่แจ้งให้ผู้ซื้อทราบลักษณะของธุรกรรมอย่างครบถ้วนขณะขาย อ.ย.
